Major pollution emitters violating the Clean Air Act aren't getting fined the federal minimum fee in at least 18 states, according to a report from the Environmental Integrity Project (EIP). The nonprofit's analysis found a $52.8 million shortfall in pollution fees collected from 2002 to 2005 from companies including ethanol plants. The minimum fee is $39.48 per ton for at least the first 4,000 tons of emissions of each specific pollutant. These fees are used to fund state-level monitoring, permitting and enforcement of the act.
