EPA delivers proposed rule with 2020 RVOs, “other changes” to OMB

The U.S. EPA has delivered a proposed rule to set 2020 renewable blending obligations (RVOs) under the Renewable Fuel Standard to the White House Office of Management and Budget. The proposed rule also includes the 2021 RVO for biomass-based diesel and “other changes” to the RFS program. OMB review marks a final step before a proposed rule is released for public comment.

Information posted to the OMB website shows the proposed rule was delivered on May 6. The posting, however, does not include any additional information on what “other changes” to the RFS program the rulemaking might include.

While a representative of the EPA did return a message from Biomass Magazine seeking additional information on what the “other changes” referenced in the rulemaking pertains to, the agency’s statement did not elaborate on what those “other changes” might be.

“The proposal is currently under interagency review, which places the Trump administration on track to release the Renewable Fuel Standard renewable volume obligations (RVOs) on time for the third consecutive year, this is in contrast to the previous administration which frequently failed to release their RVOs by the date intended by Congress,” said Michael Abboud, EPA spokesman, in an emailed response.
