EPA proposal allows landfill gas to generate RINs under RFS

The U.S. EPA has released a notice of proposed rulemaking that would allow renewable diesel, renewable naphtha, and renewable electricity—used in electric vehicles—produced from landfill gas to generate cellulosic or advanced biofuel renewable identification numbers (RINs) under the renewable fuel standard (RFS).

Renewable compressed natural gas and liquefied natural gas produced from landfill biogas are also proposed to generate cellulosic RINs.

Additionally, EPA is proposing to allow butanol that meets the 50 percent greenhouse gas emission reduction threshold to qualify as advanced biofuel.

The rulemaking proposes a clarification regarding the definition of crop residue to include corn kernel fiber and proposes an approach to determining the volume of cellulosic renewable identification numbers produced from various cellulosic feedstocks. Read more about it here

Several other amendments to the RFS are included.

"Without commenting on any particular part of the rule making, the ABC is pleased that the EPA has issued the notice of proposed rulemaking," said American Biogas Council Executive Director Patric Serfass. "ABC as an organization and many of its member companies have been anticipating the release of this rule for some time. We are very excited to be working with the EPA to shape a pathway for biogas and its transportation uses, and look forward to a final rule being released later this year."

Bob Perciasepe, EPA acting administrator, signed the notice of proposed rulemaking on May 20. It has been submitted for publication in the U.S. Federal Register, after which it will undergo a 30-day comment period.
