Novozymes A/S has sued Danisco A/S, claiming patent infringement by Danisco over an enzyme used in biofuel production. The case, filed in Wisconsin, claims Danisco's use of the enzyme alpha-amylases violates Novozymes U.S. patent for the enzyme. During the court hearing, a spokesman for Novozymes said the company and its U.S. division, "have suffered and will continue to suffer irreparable injury and damages," from Danisco using the patented technology. Novozymes has not released the amount of damages it is seeking in the case.
While Danisco could not immediately comment, according to spokesman Johan Corneliussen of Danisco, Novozymes issued the following statement:
"On Tuesday May 11, 2010, Novozymes filed a complaint in the U.S. District Court in the Western District of Wisconsin against Danisco for patent infringement. Novozymes believes that Danisco's alpha-amylase products GC358 and Clearflow AA for the biofuel and starch industries infringe Novozymes' U.S. patent 7,713,723. As part of the complaint, Novozymes has also filed a permanent injunction. Novozymes will now await the court's decision and cannot comment further on the case at this time."
