EPA: 35 SRE petitions currently pending

The U.S. EPA published updated small refinery exemption (SRE) data on Feb. 15, reporting that 35 SRE petitions are now pending, up from 15 that were pending as of mid-January. No new SRE petitions were filed, but 20 previously denied petitions are being reconsidered by the agency. 

The 35 pending SRE petitions now include two pending for Renewable Fuel Standard compliance year 2024, eight pending for RFS compliance year 2023, three pending for RFS compliance year 2022, two pending for RFS compliance year 2021, six pending for RFS compliance year 2020, six pending for RFS compliance year 2019, seven pending for RFS compliance year 2018, and one pending for RFS compliance year 2017.

The EPA earlier this year began to publish company names and facility locations for SREs filed with the agency on or after July 1, 2022. That data shows that the pending SRE petitions include those filed by U.S. Oil & Refining Co., Wyoming Refining Co., Ergon Refining, Eron-West Virginia, Placid Refining Co., Calumet Montana Refining, Calumet Shreveport Refining, Hunt Refining Co., and Wynnewood Refining Co.

The EPA’s online SRE data dashboard also includes data on small refineries that have opted into the agency’s alternative renewable identification number (RIN) retirement schedule for the 2020 compliance year. According to the EPA’s online data dashboard, 17 small refineries are participating in the alternative RIN retirement schedule, with the total renewable volume obligation (RVO) for those refineries at 880 million RINs. A total of 540 million RINs have been retired under the alternative retirement schedule as of Jan. 18. The total outstanding RVO is currently at 340 million RINs, according to EPA’s data dashboard.
