EPA denies 2 SRE petitions

The U.S. EPA on Jan. 2 denied two small refinery exemptions (SREs) for Renewable Fuel Standard compliance year 2023, according to updated data posted to the agency’s online SRE data dashboard. No other actions were taken and 129 SRE petitions remain pending. 

One of the two petitions was filed by Wynnewood Refining Co. in December 2023 seeking a waiver of the compliance year 2023 RFS blending requirements for its refinery located in Wynnewood, Oklahoma. The other was filed by Calumet Montana Refining in December 2023 seeking a waiver of the compliance year 2023 RFS blending requirements for its refinery in Great Falls, Montana. The EPA was under court orders to respond to the two SRE petitions by Jan. 2 and Jan. 3, respectively. Several other legal challenges related to the EPA’s SRE program are currently pending in the courts.

The remaining 129 pending SRE petitions include two for compliance year 2016; one for compliance year 2017; 38 for compliance year 2018; 27 for compliance year 2019; 28 for compliance year 2020; five for compliance year 2021; three for compliance year 2022; 12 for compliance year 2023; 10 for compliance year 2024; and three for compliance year 2025.
